Terms of Service

These Terms of Service ("Terms") govern your access to and use of SalonCue, including our mobile application and web platform (the "Service"). By accessing or using SalonCue, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use the Service.

1. Service Description

SalonCue is a salon management platform specifically designed for nail salons. The Service includes:

  • •Turn board and queue management
  • •Commission and payout calculations
  • •Digital point-of-sale (POS) system
  • •Customer management and loyalty programs
  • •Payroll and financial reporting
  • •Optional card payment processing via Stripe (Phase 5)

The core Service (turn board, commission calculations, cash checkout, reports) does not require Stripe. Card payment processing is entirely optional.

2. User Accounts

Account Creation

You must provide a valid phone number to create an account. You are responsible for maintaining the confidentiality of your account and are fully responsible for all activities that occur under your account.

User Roles

Accounts have defined roles: Owner, Manager, or Technician. Each role has different permissions and data access.

  • Owner: Full access to salon settings, payroll, reports, and all transactions
  • Manager: Access to most features except payroll and billing
  • Technician: Access only to their own turn queue, earnings, and timecard

Authentication

We use phone number OTP (one-time password) for authentication. There are no passwords. You are responsible for keeping your phone secure.

Account Termination

You may cancel your account at any time through the Service settings. Salon owners must ensure all payroll is settled before cancellation. We may terminate accounts that violate these Terms.

3. Payment Processing & Billing

Subscription Tiers

  • Free Tier: Includes turn board, cash checkout, basic reports, up to 3 users. No credit card required. Limited to one salon.
  • Paid Tier: Unlimited users, advanced reporting, payroll management, customer loyalty, multi-location support (future). Pricing will be announced before billing begins; once active, subscriptions are billed monthly on your subscription anniversary date.

No Long-Term Contracts

Paid subscriptions are month-to-month with no long-term commitment. You can cancel anytime. Cancellation takes effect at the end of your billing cycle.

Card Payment Processing

Optional card payment processing is powered by Stripe. By using Stripe payment features:

  • • You agree to Stripe's Terms of Service
  • • Your card details are processed by Stripe, never stored by us
  • • You are responsible for all Stripe fees and transaction costs
  • • Card payment setup requires Stripe Connect verification (business information, bank account)

Cash Transactions

Cash checkout is supported in all salons. We do not process cash transactions or hold funds. Salon owners manage all cash handling.

Refunds

Subscription charges are non-refundable except as required by law. Transaction refunds (cash, card, gift card) are initiated by salon owners through the Service.

4. Data Ownership & Use

Salon Data Ownership

Your salon data (transactions, customer information, reports, payroll records) is owned by you. You retain all rights to your data. We are a custodian of your data, not an owner.

Service Rights

We retain the right to use anonymized, aggregated data to improve our Service, develop new features, and conduct analytics. This data cannot identify your salon.

Data Export

You can export your data at any time in standard formats (CSV, JSON). Upon account cancellation, you have 90 days to export your data before it is deleted.

5. Acceptable Use Policy

You agree not to:

  • •Use the Service for illegal activities or in violation of local laws
  • •Attempt to gain unauthorized access to the Service or other users' accounts
  • •Transmit malware, viruses, or malicious code
  • •Harass, threaten, or abuse other users
  • •Reverse engineer, decompile, or attempt to derive the source code
  • •Scrape or systematically download data
  • •Interfere with the Service's normal operation

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALONCUE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • •We are not liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, lost data, or business interruption)
  • •Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • •We are not liable for errors, omissions, or inaccuracies in the Service

This limitation applies to all claims, whether arising in contract, tort, strict liability, or otherwise, and applies even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless SalonCue and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • •Your use of the Service
  • •Your violation of these Terms
  • •Your violation of any applicable law or regulation
  • •Your infringement of any third-party rights

8. Service Modifications

We may modify or discontinue the Service or any part of it at any time. We will provide notice of material changes via email. Your continued use of the Service following such modifications constitutes your acceptance of the changes.

9. Termination

We may terminate or suspend your account immediately, without notice or liability, for any reason, including if you breach these Terms. Upon termination, all rights to use the Service will be revoked.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the United States.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SalonCue regarding the Service and supersede all prior and contemporaneous agreements and understandings.

13. SMS Messaging Program

Salons using the Service may send appointment text messages to their customers through SalonCue, our messaging platform. By providing your mobile number and checking the SMS consent box when you book online or check in, you agree to receive appointment text messages (confirmations, reminders, and cancellation notices) from the salon via SalonCue.

Message frequency varies based on your appointments. Message and data rates may apply. Reply STOP at any time to unsubscribe from all appointment texts, START to resubscribe, or HELP for assistance. Opt-out requests are honored immediately.

We do not sell or share your mobile number or SMS opt-in consent with third parties for their own marketing. Your number is shared only with our SMS provider to deliver the messages you requested. Mobile carriers are not liable for delayed or undelivered messages. See our Privacy Policy for details.
